Capital Gains Changes

Current Rules (Unchanged for 2027)

Taxpayer Inclusion Rate
Individuals 50% (all gains)
Corporations 50% (all gains)
Trusts 50% (all gains)

A 2024 federal budget proposal would have raised the rate to 66.67% for individual gains above $250,000/year (and for all corporate and trust gains), but the Government of Canada cancelled the increase entirely on March 21, 2025. There is no $250,000 threshold and no tiered structure — the flat 50% rate is expected to continue into 2027.

Planning Implications

Strategy Consideration
Timing of sales No threshold to manage — rate is flat
Spousal ownership Each spouse reports gains at their own marginal rate

Starting with the 2026 taxation year, certain “reportable bare trusts” become subject to the rules under subsection 150(1.3) (exceptions in 150(1.31)), but CRA has not yet published the full criteria – confirm the latest guidance before the 2026 T3 filing season. See the full bare trust rules guide for details.
